A stopgap funding bill signed September 2, 2026 pushed the bulk of Section 781 of P.L. 119-37 from November 12 to December 11, 2026. The standard itself did not soften: total THC, per container, replacing the 0.3% delta-9 dry-weight test.
The delay did not cover synthetics. Cannabinoids not naturally produced by the plant fall out of the hemp definition on the original November date, so converted delta-8 and similar SKUs have less runway than the headline deadline suggests.
Several states have banned or license-gated intoxicating hemp outright, others cap milligrams per serving and per container, and a third group still runs on the old delta-9 test. Re-check your top five revenue states monthly — the federal date does not reset a state ban.
Bills to extend, repeal, or replace the change with regulation remain in committee, and challenges over synthetic scope and state pre-emption are expected. Build for December 11 landing as written.
